If I was a builder who had the intention of cheating his buyers for their earnest money, upon the advice of a counsel I will launder money in a way it becomes untraceable in-order to make personal gains. Laundering in a way which makes the money untraceable is the best defense for a builder to support his cause for slow or no progress of the work.
In Mohali, a dream project of the former Badal Government touted to the first Busopolis: a bus terminal with a commercial center and hotel in the region. Mohali Junction was launched in 2009 and was promised to be delivered in December 2011.
After a decade of launching the project, only the ISBT has become operational. The investors of the retail shops and office spaces are in distress.
After failing to appear before the court, magistrate Deepika declared the chairman, managing director (MD) and director of C&C Towers Ltd. were declared as proclaimed offenders (PO), in the case of cheating the buyers of commercial shops and offices at Mohali Junction’s commercial complex in Ph. 6, Mohali.
Three FIRs were registered in August 2018 by the investors alleging cheating against Gurjit Singh Johar, Chairman, MD Charanbir Singh Sethi and director Sanjay Gupta of C&C Towers Ltd., the firm which developed the Mohali Junction.
In the complaint, the aforementioned company’s representatives had cheated the investors of the money they had deposited with the company. A part-payment of the total cost had been paid by every investor for the retail shop.
Due to the reason for non-delivery of the possession even after years, the investors before lodging FIRs sought a refund from the company. After repeated assurances from the company, the complainants had to knock the doors of the law.
The case against the three was registered under the following sections of the Indian Penal Code (IPC):
- Section 406: Criminal Breach of Trust
- Section 420: Cheating and Dishonesty including Delivery of Property
- Section 120B: Criminal Conspiracy
The next hearing is scheduled for November 16, 2019.
